Indian Muslim representative body files petition to apex court over disputed holy land

12-15-2010 09:07 BJT

NEW DELHI, Dec. 14 (Xinhua) -- The all India Muslim representative body Sunni Central Waqf Board Tuesday filed a petition in the Supreme Court challenging the recent Allahabad High Court judgment in the Babri Masjid title suit.

The Waqf Board is one of the original litigants in the Ram Janmabhoomi-Babri Masjid title suits.

Advocate Zafaryab Jilani, who is appearing for the board, said the petition argues that the High Court verdict is based on faith rather than documentary evidence on where Lord Ram was born.

The petition also argues that the verdict violates Articles 25 and 26 of the Indian Constitution which give equal rights to all faith.

The appeal has the endorsement of the All India Muslim Personal Law Board.

The Lucknow bench of the Allahabad High Court, in the northern Indian state of Uttar Pradesh, on Sept. 30 pronounced its judgment in the Ayodhya title suit, saying Hindus and Muslims are joint title holders.

The three-judge bench -- comprising Justice S. U. Khan, Justice Sudhir Agarwal and Justice D. V. Sharma -- ruled in a majority judgment two to one, that there be a three-way division of the disputed land -- one-third for the Sunni Waqf Board, one-third for the Nirmohi Akhara and one-third to the party for deity "Ram Lalla.
