Third soldier convicted in Danny Chen suicide

Staff Sergeant Blaine Dugas was convicted, Friday, of not adequately supervising the soldiers who repeatedly hazed and abused a Chinese-American soldier in the Fall of 2011. Private Danny Chen ultimately killed himself October 3, 2011 after enduring six weeks of mistreatment while serving on a remote outpost in Southern Afghanistan.

After hearing testimony from 20 witnesses over two days, a military jury convicted Dugas, of dereliction of duty for failing to foster a climate where all are treated with dignity and respect, regardless of race and failing to prevent his subordinates from engaging in abusive conduct towards Private Chen.

Dugas had also pleaded guilty to wrongfully possessing and consuming alcohol. He was acquitted of making a false statement to an investigating

official regarding Chen’s death, claiming he wasn’t informed of the maltreatment.

Dugas was sentenced to reduction in rank and three months in jail, but he was given credit for time he had already spent in jail.

"We are extremely disappointed by the Judge's light sentence. As the senior enlisted officer, Sergeant Dugas was in a position of power to stop the abuse and didn't. His failure to ensure the physical well being of Private Chen cost Danny his life. There is no place in the Army for a staff sergeant, the highest enlisted officer who turns a blind eye to racial abuse and hazing by superiors," stated Elizabeth OuYang, president of OCA-NY, the lead advocacy organization advocating for justice for Private Danny Chen.
