Sany Heavy Industry: 'historic victory' in wind farm purchase

07-17-2014 11:09 BJT

"A historic victory." That what Chinese machinery manufacturer Sany Heavy Industry is calling its US-based subsidiary’s successful appeal of a wind farm purchase against US President Barack Obama.

A US federal appeals court ruled on Tuesday the government violated rights of Ralls Corporation. when it rejected the company’s bid to purchase US wind farms. The president of Sany Heavy Industry Corporation says his company and its Ralls subsidiary welcome the ruling.

In September 2012, Obama issued a presidential order to prevent Ralls from owning four wind farms in Oregon. The presidential order cites national security risks as their locations were near the Naval Weapons Systems Training Facility.

Ralls sued Obama, claiming that the presidential order exceeded its constitutional rights and failed to provide detailed evidence. The District of Columbia Circuit ruled that the presidential order, without due process of law, had deprived the company of its protected property interests. That’s valued at 6 million US dollars.
