Solar panel probe: Why US, not Europe?

Of the seven US companies that filed the petition against the Chinese solar panel industry, six are anonymous. The seventh is SolarWorld, the American arm of one of Germany’s largest solar product manufacturers. It’s raised the question - why would a German company chose to sue in the US instead of in Europe? And what might be the impact on China’s solar panel industry?

According to related laws in Europe and the US, the output of all companies filing such a petition, must total at least 25 percent of the entire industry volume in the country or bloc. The solar energy industry in the United States is much smaller than that of Europe’s.

Defense lawyer Li Lei from China Solar Energy Companies said: "The EU a main bases for the world’s solar industry, so several EU companies can barely represent all of Europe. The industry in the US is very small, therefore it is much easier to launch an investigation there with just several firms."

With three American solar product companies having applied for bankruptcy protection since August, some believe politics is playing a role in the investigation.

Zhao Yuwen, vice president of China Renewable Energy Society, said: "One of the reasons that the American government supported the investigation is that they are going to have an election soon."

About 80 percent of China’s solar products are exported to Europe. The industry is concerned that the US investigation may lead to similar cases in the EU, which could destroy Chinese solar energy companies.

A Chinese senior official said the nation is prepared to take its own measures to protect the industry.
